Attorney General Race Has Mortgage Banking Implications

As we look toward an upcoming election for the attorney general office I wanted to pass along some important information you may or may not be aware of that is of great concern to our industry.
The current attorney general that is running for re-election, Mr. Terry Goddard is spearheading a predatory lending law for the State of Arizona. For those of you that are not familiar with these laws I can briefly state that they do NOT work. While intended to protect consumers from unscrupulous lenders that either price gouge or "bait and switch consumers," these laws actually become so prohibitive they eliminate many valuable loan options for the consumer. These laws place such a limit on who is eligible for certain loan programs, and more importantly how much can be earned on a loan, that previous states with such legislation have seen lenders simply stop doing business in that state. Georgia tried one for a short time only to repeal the law, and if anyone has attempted a loan in New Mexico it's almost not worth your time. We on the other hand enjoy doing loans in the state of Arizona and believe that delivering a valuable service to the residents of Arizona is our lifeblood.
Members of the AMS executive staff recently had the opportunity to meet with the gentlemen running on the Republican ticket for the Arizona Attorney General, Mr. Bill Montgomery. Below is an article written by Mr. Montgomery, our hope is that the employees of AMS will wholeheartedly support Mr. Montgomery in his campaign and election efforts.
ENABLING THE AMERICAN DREAM
A Letter Submitted By Bill Montgomery, Arizona Attorney General Candidate
I want to salute the people who make up American Mortgage Specialists and share my own home owning experience to illustrate my degree of respect and appreciation for those who help people make an important aspect of the American Dream a reality.
My wife Becky and I came to Arizona for several reasons but important among them was the recognition that this State provided an opportunity to buy and own a home of our own. When we finally got down to business and undertook the process of purchasing a home, and before we ever went looking, we sat down with a mortgage specialist to determine what we would be able to qualify for and afford. With the assistance of our partner in this home purchase, and we did look at our realtor and loan officer as part of our home buying team, we were able to establish a solid budget that kept us within our means and enabled us to accomplish a shared lifetime dream.
That first day as homeowners was a very emotional one. You see, I had lived in 16 different places before ever even graduating from high school and Becky had a similar experience growing up. With welfare often being the only source of income for my Mom to raise myself and younger sister and brother on, some of those moves were not voluntary. Added to that were the frequent moves and deployments that are a part of life in the Army. Ultimately, stability and developing roots in a community were aspirations that owning our own home made a reality.
Today, the American Dream is within the grasp of more Americans than at any other time in our nation's history, as illustrated by the historic rate of home ownership. A key component of this is the ability of Americans to choose among a number of different mortgage products and services that best fit their financial circumstances. As a candidate for Arizona Attorney General, I want to insure that Arizona citizens will continue to have the freedom to choose the nature and scope of their dream for home ownership and to have access to as many different mortgage products and services to help them accomplish their dreams. At the same time, I want to also insure the unscrupulous con artists and outright thieves do not unfairly take advantage of people in pursuit of their dreams and rig them for financial failure. By encouraging opportunity and choice, we can keep the market for mortgage products competitive while keeping the cost of doing business legally and ethically down by aggressively prosecuting predators of consumers. I have no doubt that companies such as American Mortgage Specialists and its employees will continue to thrive and enjoy great success in such a business environment. Together, we can see to it that my experience, and those of countless thousands of other Arizona citizens, will be repeated for many more generations to come.

I have been working with AMS since October, 2001.

Where did you attend college?
L:
I majored in communications at ASU on a tennis scholarship.

How has your experience been working with AMS?
L:
Everybody who works for AMS is very professional, motivated and a pleasure to work with. My experience with AMS has been very positive and you truly feel like it is a team working together.
A:
What do you like most about banking with AMS?
L:
What I like most about banking with AMS is the knowledge of the staff, from the loan being set up all the way through to funding. Because of everybody knowing what their tasks are, the turn around times are great. Once again, it feels like everybody is on your team trying to achieve the same goal.
A:
What do you enjoy doing when not at work?
L:
I enjoy spending time outdoors….playing tennis, hiking, and running. Also, most of my family lives in Arizona, so I enjoy spending time with them.
A:
How is it working with Cami?
L:
I have worked with Cami for a couple of years now. She used to work with First Magnus and was my coordinator there. When I heard she was working with AMS, I was ecstatic. She is very professional, knowledgeable and always goes above and beyond to get the job done. She makes my job so much easier.
A:
How has your quality of life improved since joining AMS?
L:
When you work with professional people who know what they are doing, and get the job done efficiently and quickly, that takes the stress and pressure off of me. That definitely improves the quality of life in an individual.
A:
How do you do your business?
L:
I work out of my house and have no problem working after hours and during the weekend. My clients love that I have this flexibility. I process and originate my own loans. I like doing both, because I am familiar with the client/file 100% of the time.
A:
How do you rate turn times?
L:
The turn times at the AMS bank are great.
A:
How many transactions a month have you historically done?
L:
I will do 5-8 transactions a month, but have done as many as 15.
A:
What type of loans do you normally do?
L:
The majority of my clients are A paper and are conservative. So I normally do conventional 30 year fixed (I/0). I did have a sub-prime loan that I just sent to AMS, and it was a very positive experience. It makes me confident to start tapping more into that market.
A:
You have been with us 4 years now and just started banking with us, what was your reluctance?
L:
My reluctance with banking with AMS initially was because of the feedback I was getting from the other branches that were using AMS. I heard the turn times were not great and they were out of the ballpark with pricing. I am glad I finally used AMS for some of my deals, because I found that this is not the case anymore.

Matt's Irish Stew

Ingredients:
12 ounces lean, boneless lamb, cut into 1-inch cubes
2 cups beef broth
1/4 teaspoon salt
1/8 teaspoon pepper
1 bay leaf
3 medium potatoes, peeled and cut into 1-inch chunks
2 medium onions, cut into wedges
1-1/2 cups sliced carrots
1/2 teaspoon dried thyme, crushed
1/2 teaspoon dried basil, crushed
6 Pints Guinness 1/2 Pint for recipe, rest for self consumption.
2 tablespoons all-purpose flour
1/3 cup dairy sour cream
2 teaspoons snipped fresh mint
Directions:
1. In a large saucepan or pot combine lamb, broth, salt, pepper, and bay leaf. Bring to boiling; reduce heat. Cover and simmer for 30 minutes. Skim fat off meat mixture. Add potatoes, onions, carrots, thyme, and basil. Cover and simmer for 30 minutes more or until vegetables are tender. Discard bay leaf.
2. In a small bowl stir together beer or water and flour. Stir into meat mixture. Cook and stir until thickened and bubbly. Cook and stir 1 minute more.
3. To serve, stir together the sour cream and mint. Spoon some of the sour cream mixture atop each serving. Makes 4 servings.

Computer-On-A-Stick
No longer are flash memory hard drives reserved for just documents or mp3 files. Now, thanks to the folks at Fingergear, you can carry a mini computer with you. The aptly named “Computer-On-A-Stick,” is a small lighter-sized USB drive that carries its own operating system (Linux), a complete Microsoft Office-compatible suite of office software, a web browser, calculator, AOL-compatible chat program, email program... basically, everything in your current computer, only a lot smaller.
It works beautifully. Simply tell your computer to boot to the USB drive. You can do this even if your hard drive is fried, since you'll be working in the BIOS, which loads before any hard drive-based information. Your machine will boot to the Computer-On-A-Stick, and you'll soon be doing everything you want to do without using your hard drive at all.

He has worked both as a Loan Officer, Lon Processor and is a licensed Commodity Trading Advisor. Community Affairs Update

Wow! What a great weekend for American Mortgage Specialists and US Preferred Realty! For those of you not fortunate enough to attend our charity events-you missed out! We had a great team both days and I would like to personally recognize and thank them: Magda Provencio, Ana Brown, Lena De La Rosa, Yvette Sierra, 11 year old Chelsie Perea, Sam Pearson AND- our new charity mascot-9 week old Isabela Brown.
Saturday-Make A Wish Foundation
We handed out our power bars and sports bottles, and helped cheer on all of the participants. We had the chance to meet 8 year old Ian Austen, a recipient of a wish who is on a mission to raise over 1 million $ to grant all of the wishes still out there in Arizona. He himself collected and donated $1200.00. He also handed out the raffle prizes and hosted a spur of the moment auction, which raised another $375.00 after the race. Make A Wish Foundation is also the charity recipient of our 1st Annual AMS Golf Tournament in May. This event was also covered by The Tribune and Channel 2 news.
Sunday-Sunshine Acres Children’s Home
This is an annual fundraising event BBQ put on by the Optimist Club. Our awesome team help shred over 1800 pounds of beef!! There was great community support at this event. There were lots of activities throughout the entire day, and we even got to meet some of the children living there. The day ended with a great performance by The Children’s Choir. Sunshine Acres was founded in 1954 and is the home to 65-70 children ages 5-18. Over 1500 children have grown up there. They do not solicit or promote, and are funded through private donations, corporate gifts and estates, and of course the Annual BBQ. It was an honor for us to serve our community and represent American Mortgage Specialists and US Preferred Realty.
March Events-
March 11- A Lark In The Park
This is another 5K run being held at The Phoenix Zoo to benefit The New Foundation. This Foundation helps strengthen and foster healing for troubled teens that have been abused. It is from 7am to 11:30am. There will be food, a live band, raffle prizes, and children’s activities.
March 24 & 25-Special Olympics-Basketball and Cheerleading Competition
This competition will be held at Red Mountain High School.

Loan officer says "well, I've seen Heaven, its beautiful, with all the angels, clouds, etc, but I've never seen Hell so I'm not sure.
God says "would you like to see hell?", He opens a covered door and lets the loan officer look in.
The Loan Officer sees people having a good time, partying, and relaxing.
The Loan Officer says, "boy that looks like fun, may I have a day to think about it??"
God says, sure,take the evening and I'll talk with you tomorrow.
Next day, Loan officer meets up with God again.
He says "you know its so beautiful here and all, but when you showed me Hell and they were all having such a good time, I think I'll take Hell.
God says ok, and opens the door to Hell again and now the people are fire and brimstone, and working and sweating, etc.
Loan Officer says "whoaaaaaaaaa, this isnt what you showed me yesterday"
God says "You should have locked"

Mortgage Rates Mixed But ARMs Not Much Of A Bargain

Freddie Mac's Primary Mortgage Market Survey for the week ended February 16 reported mortgage interest rates at their highest levels of the New Year.
30-year fixed mortgage rates averaged 6.28 percent, an increase of 4 basis points since the previous week's report. The 15-year fixed rate product increased from 5.84 to 5.91 percent. Fees and points for both types of fixed rates dropped from 0.6 to 0.5.
The 5/1-year adjustable rates mortgage increased to 5.95 percent from 5.89 percent with fees and points down to 0.5 from 0.7 and the 1-year ARM also rose slightly from 5.34 to 5.36 percent. Fees and points were up 0.2 to 0.7 since the previous week.
The Mortgage Bankers Association's Weekly Mortgage Applications survey for the week ending February 17 reported decrease in fixed rate products.
The 30-year fixed rate mortgage declined to 6.22 percent from 6.25 percent with fees, including the origination fee, decreasing from 1.23 from 1.34. The 15-year fixed rate also declined from 5.92 percent to 5.87 percent although those fees increased to 1.21 from 1.17. The 1-year ARM, however, increased from 5.52 percent to 5.60 with points decreasing slightly from 0.99 to 0.97. All MBA figures are for 80 percent loan to value mortgages.
Applications increased 0.8 percent on a seasonally adjusted basis from last week and 3.4 percent on an unadjusted basis but were to 80 percent of the volume the same week one year earlier. Refinancing activity dropped from 41.2 percent of total applications to 38.2 percent in a week.
It is worth noting that the differential between the 1-year ARM and the 30-year fixed rate mortgage in Freddie Mac's survey is only 92 basis points while the Mortgage Bankers survey had the different in interest rates at 62 basis points. The same week last year the differential in Freddie Mac's survey was 1.47 percent. The 5/1 ARM rate is 4 basis points higher than the rate for a 15-year fixed mortgage and only lags the 30 year by 33 basis points. Nonetheless, adjustable rate mortgages, while down from 29.6 percent of all mortgage activity to 29.1 percent is still holding on to a significant market share. Freddie Mac has theorized that many lenders are discounting the adjustable rate in order to keep that segment of the market alive - otherwise it is hard to explain why so many borrowers are willing to assume the risk of an ARM for such a small and probably temporary saving.
